Terms of Service

1. Agreement to these Terms

These Terms of Service (“Terms”) govern your use of the websites and services operated by Apex Affinity Group (“Apex,” “we,” “us”), including reachtheapex.net and related member tools. By accessing or using our services you agree to these Terms. If you do not agree, do not use the services.

2. Eligibility and Accounts

You must be at least 18 years old and able to form a binding contract to create an account. Membership is by referral: new member accounts are created through the personal referral link of an existing Apex representative. You are responsible for the accuracy of the information you provide, for maintaining the confidentiality of your credentials, and for all activity under your account.

3. Independent Distributor Relationship

Apex representatives (“distributors”) are independent contractors, not employees, agents, partners, or franchisees of Apex. Nothing in these Terms or in any Apex program creates an employment relationship. Distributors are responsible for their own business expenses and tax obligations, and must comply with all applicable laws — including, for licensed insurance activity, the licensing and conduct requirements of each state in which they operate.

4. No Income Guarantee

Apex makes no guarantee of income, profit, or success. Compensation is based solely on the sale of products and services to customers in accordance with the Apex compensation plan — not on recruiting. Any earnings examples are illustrations only and are not a promise or projection of what you will earn. Most of the results a distributor achieves depend on that distributor’s own effort, skill, and market conditions.

5. Products, Subscriptions, and Payment

Certain Apex products are offered as recurring monthly subscriptions billed through our payment processor (Stripe). By subscribing you authorize recurring charges to your payment method until you cancel. Prices are as stated at the time of purchase and may change with notice. Insurance products referenced on our sites are underwritten and issued by third-party insurance carriers, are subject to those carriers’ terms, and are offered only through appropriately licensed agents.

6. Cancellations and Refunds

You may cancel a subscription at any time, effective at the end of the current billing period. Refund requests are reviewed case by case; approved refunds are issued to the original payment method. Where a commission was paid on a purchase that is later refunded, the related commission is reversed in accordance with the compensation plan. 7. Acceptable Use

You agree not to misuse the services — including by making false or misleading income or product claims; sending spam or unauthorized communications; misrepresenting your relationship with Apex or any insurance carrier; attempting to access accounts or systems without authorization; or using the services in violation of any law. We may suspend or terminate accounts that violate these Terms or the Apex policies and procedures.

8. Intellectual Property

The services, including all content, trademarks, and software, are owned by Apex or its licensors. Distributors receive a limited, revocable license to use Apex-provided marketing materials and their replicated site solely to operate their Apex business, and may not modify Apex marks or create their own advertising containing Apex marks without written approval.

9. Disclaimers and Limitation of Liability

The services are provided “as is” without warranties of any kind, express or implied. To the maximum extent permitted by law, Apex will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenues, arising from your use of the services. Our total liability for any claim is limited to the amounts you paid to Apex in the twelve months preceding the claim.

10. Governing Law and Disputes

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules. The parties will first attempt in good faith to resolve any dispute informally by contacting us. Venue for any action lies in the state or federal courts located in Texas.

11. Changes to these Terms

We may update these Terms from time to time. Material changes will be posted on this page with an updated effective date; continued use of the services after changes take effect constitutes acceptance of the revised Terms.
